COVID-19: DESAFIOS NO APARTHEID DAS VACINAS

Resumo


Inicialmente, os autores contextualizam sumariamente a crise desencadeada pela pandemia e as respostas dos organismos multilaterais na tentativa de promover ações concretas de solidariedade. Entretanto, também demonstram as falhas em promover a equidade e o impacto negativo nos países mais pobres. São discutidas as medidas propostas nos grandes foros mundiais contemporâneos. Em seguida, discutem a propriedade intelectual como barreira ao acesso às tecnologias, as alterações legislativas possíveis e as possibilidades de flexibilizar a emissão de licenças compulsórias para assegurar o acesso a tecnologias relacionadas com a pandemia, deixando clara a complexidade envolvida nas patentes relacionadas com a produção de vacinas. O nacionalismo exacerbado e o aprofundamento da desigualdade são abordados, ao mesmo tempo em que discutem os movimentos mundiais e a disputa na Organização Mundial do Comércio diante de proposta endossada por mais de cem países de suspensão temporária de dispositivos do Acordo TRIPS para evitar monopólios de tecnologias que possam provar efetividade no combate à pandemia. As falhas em caracterizar as vacinas como bens públicos diante das disputas comerciais e de mercado também são discutidas. Iniciativas em curso na região das Américas e no Brasil são apresentadas, bem como o acompanhamento de diversas propostas de alteração na lei de propriedade industrial no Brasil, em sintonia com movimentos de âmbito mundial. Finalmente são discutidas as perspectivas que enfrentamos atualmente.
